When you hire a lawyer on as your defense, he or she needs to present every option available to you. It’s part of their job. What happens though when your lawyer is not doing what they are supposed to be doing?

The first thing you should do is try to work something out. This does happen at times. Clients do get upset with their legal team. This can happen for a variety of reasons. Try to talk it out first. Tell your lawyer or legal team why you are unhappy. There might be a common ground the two of you can come to terms on.

You are can fire your attorney and get new representation. However, this is a road that might cost you.

courtFirst off, you will need to pay for all services up to this point. If you have already settled, than skip over this. This only applies to those who have yet to pay for the services that were rendered.

Now if you might have to get the judge’s okay for this. This happens when the case is already in litigation. If you are there, the judge will need to give his or her okay. You will need to provide proof your lawyer is not doing his/her job. Documentation will have to be provided. This is why I suggest keep tabs on everything that happens.

Your case will be handed back to you. Now it’s up to you to find new representation. This could also take more time and money, so be prepared. You are basically starting over from scratch on this. You will have to make payments for the new guy or girl.

This tend to take a big chunk out of a person’ account. The people this hurts the most are the ones on a limited budget. You will lose your retainer. Do not expect to get it back at all. Plus, you will need to put out more money on a retainer for the new guy.

SUMMARY

As with anything else in life, think long and hard before you fire your lawyer. Be sure that nothing can be worked out from either end. I consider this a last ditch effort. Only resort to this if you have no other choice.
